Dear Chancellor Rosa:

We are congregational Rabbis who minister to significant communities. We care for and teach thousands of children and teenagers. We are deeply invested in their development, both as committed Jews and as productive members of society. And we are deeply concerned about the proposed regulations governing nonpublic school education in New York, which could have a far-reaching negative impact on our Communities in New York and any other state where the New York policy could create a dangerous precedent.

In our community, education is valued above almost all else. Twice daily in our prayers parents are reminded that among their principal duties is to provide for the instruction of their children: “Take to heart these instructions with which I charge you this day. Impress them upon your children . . .” (Deut. 6:6). In our congregations, nearly 100 percent of school-age children attend Jewish schools, as our congregants appreciate that providing their children a solid Jewish education is a core parental responsibility and an essential means of assuring Jewish continuity.

Established and organized elementary school learning, beginning at the age of six, was regarded as compulsory in Jewish communities as early as 64 CE. In keeping with this tradition, Jewish communities have established their own schools throughout the ages.

Here as in few other countries, the Jewish passion for knowledge has produced not only great Torah scholars but also prominent leaders in almost every field. Those leaders have emerged from our yeshiva system, with its dual curriculum. The typical Jewish school day begins with Jewish studies classes, which typically run into early afternoon. Secular studies – English, Math, Science and Social Studies – are typically taught four afternoons a week.

Our morning curriculum includes the study of Biblical and other Judaic texts, frequently translated into English. There is a great deal of textual and grammatical analysis. Our children study Talmudic texts, which deal significantly with civil law, and the art of critical thinking. They are also exposed to ethical and philosophical works, which provide them with foundational lessons in character development and a moral framework for life.

With that perspective, let us turn to the regulations that have been proposed.

They would require our elementary schools to teach a dozen secular studies courses, including the arts, career development, occupational studies, and family and consumer science. In grades 7 and 8, they would be required to provide approximately 4.4 hours of secular studies instruction each weekday afternoon. The requirements for high school are similarly extensive and prescriptive.

That is untenable and unnecessary. Our children already have a heavy workload given their Jewish studies classes, which prepare them for a life of learning. These regulations would require every yeshiva to shift hours and resources away from those classes and towards courses that parents have not asked for and that no educator would suggest are core requirements.

The proposed regulations are also an invasion of our schools’ professionalism, which demands that our educators alone determine time allocation for courses given. We have sufficient experience and substantial achievement to insist that we remain the arbiters of our daily schedule. Schools familiar with their students and their backgrounds, the dual curriculum and its demands, are best capable of setting and regulating the schedule.

Every morning, we pray that “we and our children, and our children’s children, and all Jewish children be sincere students of Torah.” If adopted, these regulations will make it that much more difficult for our prayers to be realized.

We appeal to you, please let us do it our way. We shall not disappoint, except those who seek to be disappointed.

Some are quoted as saying that the ultimate purpose of “education is for improving the lives of others and for leaving your community and world better than you found it.”

If you let us, with G-d’s help, we will.

In 1922 an attempt was made by the voters of Oregon to enact the Oregon Compulsory Education Act, which would require all children between the ages of 8 and 16 to attend State School, only leaving exceptions for mentally or physically unfit children, exceeding a certain living distance from a state school, or having written consent from a county superintendent to receive private instruction. The law was passed by popular vote but was later ruled unconstitutional by the United States Supreme Court in Pierce v. Society of Sisters, determining that "a child is not a mere creature of the state". This case settled the dispute about whether or not private schools had the right to do business and educate within the United States

England and Wales

England and Wales were slow to introduce compulsory education due to the upper class defending its educational privileges. In England and Wales, the Elementary Education Act 1870 paved the way for compulsory education by establishing school boards to set up schools in any places that did not have adequate provision. Attendance was made compulsory until age 10 in 1880. The Education Act of 1996 made it an obligation on parents to require children to have a full-time education from age 5 to 16. However, attendance at school itself is not compulsory: Section 7 of the Act allows for home education

Effects on local culture and economics

In some cases schooling has been used as a tool for assimilation and a both deliberate and inadvertent tool to change local culture and economics into another form. Opponents of this effect argue it is a human right for a culture to be maintained, and education can violate this human right. Forced schooling has been used to forcibly assimilate Native Americans in the United States and Canada, which some have said is cultural genocide. Many psychologists believe the forced assimilation of native cultures has contributed to their high suicide rates and poverty. Western education encourages Western modes of survival and economic systems, which can be worse and poorer than the existing modes of survival and economic systems of an existing culture

Criticisms of the Western educational model

As mentioned above, there has been a modern-day global shift towards recognizing the importance of indigenous education. One reason for this current awareness is the rapid spread of Western educational models throughout the world. Starting in the 19th century when Native Americans were forced into U.S. government boarding schools up until today when volunteers build schools in various remote villages, there is a strong, and some might say blind, belief that a Western education or schooling is the only way to provide a "better life" for indigenous children. Throughout history, Indigenous people have experienced, and continue many negative interactions Western society (for example, the Canadian Residential School System), which has led to the oppression and marginalization of Indigenous people. The film "Schooling the World: The White Man's Last Burden" addresses this issue of modern education and its destruction of unique, indigenous cultures and individuals' identities. Shot in the Buddhist culture of Ladakh in the northern Indian Himalayas, the film fuses the voices of the Ladakhi people and commentary from an anthropologist/ethnobotanist, a National Geographical Explorer-in-Residence, and an architect of education programs. In essence, the film examines the definitions of wealth and poverty, in other words, knowledge and ignorance. Furthermore, it reveals the effects of trying to institute a global education system or central learning authority, which can ultimately demolish "traditional sustainable agricultural and ecological knowledge, in the breakup of extended families and communities, and in the devaluation of ancient spiritual traditions."[37] Finally, the film promotes a deeper dialogue between cultures, suggesting that there is no single way to learn. No two human beings are alike because they develop under different circumstances, learning, and education

The director and editor of the film Carol Black writes, "One of the most profound changes that occurs when modern schooling is introduced into traditional societies around the world is a radical shift in the locus of power and control over learning from children, families, and communities to ever more centralized systems of authority." Black continues by explaining that in many non-modernized societies, children learn in a variety of ways, including free play or interaction with multiple children, immersion in nature, and directly helping adults with work and communal activities. "They learn by experience, experimentation, trial and error, by independent observation of nature and human behavior, and through voluntary community sharing of information, story, song, and ritual." Most importantly, local elders and traditional knowledge systems are autonomous in comparison to a strict Western education model. Adults have little control over children's "moment-to-moment movements and choices." Once learning is institutionalized, both the freedom of the individual and his/her respect for the elder's wisdom are ruined. "Family and community are sidelined…The teacher has control over the child, the school district has control over the teacher, the state has control over the district, and increasingly, systems of national standards and funding create national control over states." When indigenous knowledge is seen as inferior to a standard school curriculum, an emphasis is placed on an individual's success in a broader consumer culture instead of on an ability to survive in his/her own environment. Black concludes with a comment, "We assume that this central authority, because it is associated with something that seems like an unequivocal good – 'education' – must itself be fundamentally good, a sort of benevolent dictatorship of the intellect." From a Western perspective, centralized control over learning is natural and consistent with the principles of freedom and democracy; and yet, it is this same centralized system or method of discipline that does not take into account the individual, which in the end stamps out local cultures

The law was passed by popular vote but was later ruled unconstitutional by the United States Supreme Court in Pierce v. Society of Sisters, determining that "a child is not a mere creature of the state". This case settled the dispute about whether or not private schools had the right to do business and educate within the United States

RE: Proposed Addition of Part 130 of the Regulations of the Commissioner of Education, relating to the language of “Substantially Equivalent” instruction for Non-Public School Students (as codified in the Compulsory Education Law of 1894, ch 671, s-3).

Dear Vice Chancellor Brown: Greetings and Salutations

I believe that it is in the best interests of the children of New York State that you vote against the above-referenced Additions to the Regulations,

Our Jewish culture goes back 3300 years. Whatever is good and noble in the Western civilized world can trace its source to our heritage.

Here is what the distinguished historian and Prime Minister of England, Winston Churchill, had to say about our Jewish heritage:

“We owe to the Jews a system of Ethics which, even if it were entirely separated from the supernatural, would be the most precious possession of Mankind, worth, in fact, the fruit of all other wisdom and learning together.”

A startling statement indeed. Precisely what System of Ethics is the Honorable Prime Minister referring to?—THE TEN COMMANDMENTS!

Every single major religious tradition in the world recognizes that G-D gave the Ten Commandments to millions of Jews gathered at on Mount Sinai 3300 years ago.

At Mount Sinai, G-D gave us a Sacred Duty. We were chosen to be “A light unto the nations,” to spread these ethical principles far and wide among all the nations of the world. We were chosen—chosen to carry a very heavy burden of dutiful service.

We have carried this heavy burden of responsibility throughout the 2000 years of our exile from our ancient homeland of Israel. And many barbaric uncivilized nations resented us and responded to our ethical message with torture and murder
.
As one of the last remaining survivors of the Nazi Holocaust, I can personally attest to the fact that six million of my people were brutally tortured and exterminated in our very own time by the barbarian Germans.

Nevertheless, we have persevered, and we continue to carry the burden that G-D has placed upon our people, to be “A light unto the nations.”

The heartbroken, shattered survivors of the Holocaust, and their spiritual leaders, fled the blood-soaked soil of Europe for the freedom and tolerance of America, where they slowly, painstakingly, rebuilt the Jewish communities that had been totally destroyed by the cursed Nazi murderers.

Here, in America, they found a land of freedom and tolerance, where they could rebuild their beloved Yeshiva schools, where they could continue to transmit the ethics and the Jewish heritage that had sustained our nation in the 2000 years of their exile among the nations of the world.

And, with G-D’s blessing, they succeeded magnificently in creating model Jewish communities, places where Jewish children carried forth the ethical and moral teachings of our great sages from time immemorial.

Our neighborhoods are models of safety and decency. Our children study their lessons diligently, get married, have children, and work hard to support their families.

The Supreme Court of the United States, in the famous Yoder vs. Wisconsin decision, gave the Amish community the right to pursue their own independent education system, because the Court found that the educational regulations that the State of Wisconsin wanted to impose on them would destroy their entire way of life.

Similarly, the education system that the State of New York wishes to impose on the Jewish Yeshivos would substantially sabotage the ethical and moral mission to which Almighty G-D has charged of the Jewish People.

The greatness of America has always been the freedom that has been granted, under the First Amendment of the Constitution, to live whatever lifestyle you prefer, without fear of government discrimination and oppression.

Now, that freedom has been placed under threat by the New York State Education bureaucracy, which wants to meddle into the Jewish (and Catholic, and private) school systems, which have produced some of the finest citizens in this great country.

We ask you to vote down these destructive regulations, which would choke the lifeblood out of the diverse and very successful schools in the non-public sector.
